Please read these Terms and Conditions ("Terms") carefully before using the Smart Placard Android application and related services (collectively, the "Service") operated by Smart Placard ("we", "us", or "our").

By downloading, installing, or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

1. Acceptance of Terms

By accessing or using the Service, you confirm that you are at least 13 years of age and have the legal capacity to enter into a binding agreement. If you are using the Service on behalf of an organisation, you represent that you are authorised to bind that organisation to these Terms.

2. Use of the Service

You agree to use the Service only for lawful purposes. You must not:

• Use the Service in any way that violates applicable local, national, or international law.
• Transmit any unsolicited or unauthorised advertising or promotional material (spam).
• Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
• Upload, post, or share content that is unlawful, defamatory, obscene, or infringes any third-party intellectual-property rights.
• Attempt to gain unauthorised access to any part of the Service or its related systems.
• Reverse engineer, decompile, or disassemble any part of the Service.

3. Intellectual Property

The Service and its original content (excluding user-generated content), features, and functionality are and will remain the exclusive property of Smart Placard and its licensors. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Smart Placard.

You retain full ownership of any content you create using the Service. Because all content is stored locally on your device and we have no access to it, we do not require any licence to your content.

4. No User Accounts

Smart Placard does not provide or require user accounts. You do not need to register or log in to use the Service. All content you create is stored locally on your device and is not associated with any account or identity.

5. Purchases and Payments

The Service may offer in-app purchases or subscriptions. All purchases are processed through the Google Play Store and are subject to Google Play Terms of Service. All fees are non-refundable except as required by law or as described in our refund policy.

6. Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis without any warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components.

7. Limitation of Liability

To the maximum extent permitted by applicable law, Smart Placard and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation loss of profits, data, or goodwill, arising out of or in connection with your use of, or inability to use, the Service.

8. Indemnification

You agree to defend, indemnify, and hold harmless Smart Placard and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, judgements, awards, losses, costs, or expenses (including reasonable legal fees) arising out of your violation of these Terms or your use of the Service.

9. Third-Party Links and Services

The Service may contain links to third-party websites or services. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services. We strongly advise you to read the terms and privacy policy of any third-party site you visit.

10. Termination

We reserve the right to discontinue or modify the Service at any time without notice. Because the app does not use accounts, there is no account to suspend or terminate. If you wish to stop using the Service, you may simply uninstall the app from your device, which will also remove all locally stored content.

11. Governing Law

These Terms shall be governed by and construed in accordance with applicable law. Any dispute arising under these Terms shall be subject to the exclusive jurisdiction of the competent courts in the jurisdiction where Smart Placard is established.

12. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of any material changes by updating the "Last updated" date at the top of this page and, where appropriate, providing additional notice within the app. Your continued use of the Service after changes become effective constitutes your acceptance of the revised Terms.
